Privacy Considerations of Automated Decision-Making in the Age of AI

Artificial intelligence-driven automated decision-making is reshaping industries – from risk assessments to hiring algorithms, these systems can analyze datasets and make decisions faster than humans, but this comes with responsibility. This session will focus on ADM in the age of artificial intelligence (AI) through the lens of privacy laws, with insights into restrictions that have existed for several years under laws like the EU GDPR and recent trends in the U.S, including California’s recent draft decision-making guidelines and a focus on privacy law implications. As systems become more prevalent, the intersection of AI and privacy law will only grow more complex. We will discuss the current privacy landscape as it relates to ADM which underscore the importance of transparency, fairness, accountability; provide a framework for disclosure requirements, audits, data minimization, and consumer rights; and provide insights for businesses deploying ADM systems by covering bias and discrimination, transparency, compliance, testing, validation.
