Data with Borders: the DOJ's Final Sensitive Personal Information Access Rule

Data wants to be free! Or does it? Countries are increasingly seeking to limit transfers of certain data across borders, including sensitive personal information and government- and infrastructure-related information. Europe, China and other major jurisdictions have passed laws to effectuate data localization and mandate compliance with privacy and data transfer laws. The U.S. has now joined the fray with the DOJ's Final Rule concerning specified bulk data transfers to covered countries (aka the "Provisions Pertaining to Preventing Access to U.S. Sensitive Personal Data and Government-Related Data by Countries of Concern or Covered Persons"), which goes into effect in March 2025. This session will take a deep dive into the Final Rule's requirements, implications and compliance mandates. We will explore how companies are approaching the role and the steps they are taking to comply.
